The Penalties for Repeat DUI/DWI Offenses Are Serious

DUI Penalties

2nd DUI offense: Up to $2,000 in fines and 2 years in jail, as well as 12 points on your driving record and mandatory completion of an impaired driver intervention program.

3rd DUI offense (or more): Up to $3,000 in fines and 3 years in jail (with a 10-day minimum jail sentence if your last conviction was in the past 5 years), and mandatory completion of an impaired driver intervention program.

The Maryland State Attorney General may file habitual offender papers seeking enhanced penalties, such as mandatory jail time, a lengthier alcohol program and a mandatory ignition interlock device.

Driving While Impaired by Drugs

2nd DWD: Whether legal or illegal drugs, this can result in a maximum of 2 years in jail and up $2,000 in fines.

3rd or more: A maximum of 3 years in jail and up $3,000 in fines.

Underage DUI

(A BAC if .02% under the zero tolerance law): A $500 to $1,000 fine, and
90-day license suspension. Any additional offenses result in a total loss of driving privileges.

Commercial Driver's License DUI

2nd Offense: Lifetime loss of your CDL

DWI Penalties

2nd DWI offense: Up to $500 in fines and 1 year in jail as well as 1 year minimum driver's license suspension Mandatory alcohol abuse assessment and treatment may be ordered.

3rd DWI offense: Any of the above plus a possible additional jail time, 5 years' suspended driver's license and participation in a 28-day residential treatment program.


4th DWI Offense: Any and all of the above plus indefinite driver's license revocation.

DWI with Minor in Vehicle

2nd Offense: 1 year maximum jail time and a $2,000 fine.
